Before accepting this Agreement, please be sure to read the entire content of this Agreement carefully and fully understand the terms, especially the restrictions or exemptions. The restrictions or exemptions will be highlighted in bold or other eye-catching forms to remind you. If you have any questions about the terms of this Agreement, please contact the relevant business department of Volcano for inquiries. Unless you have read and accepted all the terms of this Agreement and related agreements, rules, etc., you have no right to use this service. Once you select "Agree to the Agreement and Submit" (see the registration page for specific wording) and complete the registration process, or you use this service in any way, it is deemed that you have read and agreed to the constraints of the above agreements, rules, etc. If you violate any of this Agreement, Volcano has the right to unilaterally take measures such as restricting, suspending or terminating the provision of services to you at any time according to your violation, and has the right to hold you accountable.
This Service Agreement (hereinafter referred to as "this Agreement") is signed by you and Volcano Technology Limited (hereinafter referred to as "Volcano"). Including but not limited to: "Volcano Platform Privacy Policy" and other contents. If there are any changes, Volcano will announce them by publicizing on the website without further notice. Once the changed agreements and rules are announced, they will automatically take effect and become part of this Agreement without further notice to you. If you do not agree to the relevant changes, please stop using Volcano's services immediately; if you continue to use them, it will be deemed that you have no objection to the modified rules and agree to comply with them.
1. Definition of terms
1.1. Licensed Software: refers to the software system developed by Volcano for you to download from the platform and install and use in a limited system mobile terminal.
1.2. Service: The service provided to you by Volcano Technology Limited . You can use the service on your mobile terminal through the licensed software.
2. Services
2.1. Volcano provides you with smart light device management services. You can control the smart terminals connected to the Volcano cloud platform through Volcano and realize the linkage between smart devices. The service content includes smart device management, scene linkage, analysis reports, etc. These functional services may be optimized or modified according to changes in user needs or the unilateral judgment of the service provider, and may also be temporarily suspended due to regular or irregular maintenance.
3. Service Scope
3.1. Volcano grants you a right to use this product in relation to this software.
3.2. You may not license, sell, lease, transfer, distribute or use this product for any other commercial purpose.
3.3. Due to software adaptation platform and terminal restrictions, you may only use the licensed software on authorized system platforms and terminals. If you install the licensed software on other terminal devices, it may damage your hardware or software functions.
3.4. You should understand that the Licensed Software can only be used for non-commercial purposes and cannot be installed, used or run for commercial purposes. If you need to do so, you must obtain Volcano's written authorization and permission in advance.
3.5. Volcano will change, upgrade or transfer the licensed software and its related functions from time to time, and may add new functions or services to the licensed software system. If there is no independent agreement for the above new functions and services, you can still obtain the authorization of the corresponding functions and services, and this Agreement shall apply.
3.6. You shall be responsible for the accuracy, reliability, completeness and legality of the input data and the legality of the way you obtain the data, and shall regularly back up the data and materials. You shall bear all risks of damage or loss of such materials.
3.7. You should keep your account and password safe. If you find that your account has security risks (including but not limited to password leakage), you should notify Volcano in time and Volcano will assist you in taking relevant measures. Otherwise, you are responsible for all actions under your account and you shall bear all responsibilities.
IV. Third Party
4.1. You are aware that some of Volcano’s services may be obtained through the use of software or services provided by a third party. Such services are provided to provide you with convenience and are legally authorized by the third party.
4.2. This product contains some information and services of third parties. Volcano does not control and is not responsible for the information and services of third parties.
4.3. You understand that Volcano cannot guarantee that the licensed software will permanently use or include such services, nor can it guarantee whether it will continue to use other software provided by the same third party in the future. It may also use similar services from other third parties. Once the above-mentioned corresponding software or services are activated, this agreement shall also apply.
V. Service Specifications
5.1. You should use the licensed software in a standardized manner. The following methods are in violation of the usage specifications: 1) Publishing or sharing computer viruses, worms, malicious codes, software that intentionally damages or changes computer systems or data; 2) Collecting other users' information or data, such as email addresses, without authorization; 3) Using this product maliciously in an automated manner to impose excessive burdens on the server or otherwise interfere with or damage the website server and network links; 4) Attempting to access the server data or communication data of this product without authorization; 5) Interfering with or disrupting the use of this product by other users.
5.2. You understand and agree that: 1) Volcano will determine whether you are suspected of violating the above usage regulations, and suspend or terminate your use license or take other restrictive measures that can be taken according to the contract based on the results of the determination. 2) Volcano will directly delete any information that is suspected of being illegal or infringing on the legal rights of others or violating this Agreement when you use the licensed software. 3) If your violation of the above usage regulations causes damage to any third party, you need to bear legal responsibility independently in your own name and should ensure that Volcano is free from losses or increased expenses, otherwise Volcano has the right to claim compensation from you. 4) If you violate relevant laws or the provisions of this Agreement and cause Volcano to suffer any losses, you shall compensate Volcano for the losses and (or) expenses incurred thereby.
VI. Information Content Standards
6.1. You promise not to use the Service for any illegal or improper activities, including but not limited to the following:
6.1.1. Upload, transmit or share information containing any of the following content: 1) Oppose the basic principles established by the Constitution; 2) Endanger national security, disclose state secrets, subvert the state power, and undermine national unity; 3) Damage the national honor and interests; 4) Incite ethnic hatred, ethnic discrimination, and undermine national unity; 5) Undermine the state’s religious policies and promote cults and feudal superstitions; 6) Spread rumors, disrupt social order, and undermine social stability; 7) Spread obscenity, pornography, gambling, violence, murder, terror, or abet crimes; 8) Insult or slander others and infringe on the legitimate rights of others; 9) Contain false, fraudulent, harmful, coercive, infringing on others’ privacy, harassing, infringing, slanderous, vulgar, obscene, or other morally offensive content; 10) Contain other content restricted or prohibited by applicable laws, regulations, rules, ordinances, and any other legally binding norms.
VII. Privacy Policy and Data
7.1. Protecting your personal information is very important to Volcano. Volcano has formulated the Volcano Smart Platform Privacy Policy, which makes important disclosures on the ownership and protection of intellectual property rights, the collection, use, sharing, storage, and protection of your information. It is recommended that you read the Volcano Smart Platform Privacy Policy in its entirety.
8. Disclaimer
8.1. Unless otherwise expressly provided by laws and regulations, Volcano will make every effort to ensure that the licensed software and the technology and information involved are safe, effective, accurate and reliable, but due to the limitations of existing technology, Volcano cannot guarantee this.
8.2. You understand that Volcano cannot be held responsible for your direct or indirect losses caused by force majeure and third-party reasons.
8.3. You shall be solely responsible for any personal injury or incidental or consequential damages arising from or related to any of the following: 1) Unauthorized use of the Licensed Software or modification of your data by a third party; 2) Expenses and losses arising from actions performed using the Licensed Software; 3) Your misunderstanding of the Licensed Software; 4) Other losses related to the Licensed Software that are not caused by Volcano.
8.4. Any software derived from any other licensed software that is not developed and officially released by Volcano or authorized by Volcano is illegal. Downloading, installing, and using such software may lead to unpredictable risks. The legal liabilities and disputes arising therefrom have nothing to do with Volcano. Volcano has the right to suspend or terminate the use license and/or all other services.
8.5. You are aware that the use of Volcano Platform involves Internet services, which may be affected by unstable factors in various links. Although Volcano has taken security measures, this service may still be suspended, interrupted, delayed, restricted in use or unable to be used due to inherent defects in the Internet and electronic communications and time that cannot be reasonably controlled by any party to this Agreement (including but not limited to fire, flood, terrorist attack, plague, natural disaster, riot, terminal virus, hacker attack, network failure, terminal failure). You hereby specifically assume the above risks and agree that Volcano shall not bear any liability to you if the actual occurrence of the above risk events affects the normal operation of the service.
IX. Termination of Agreement and Liability for Breach of Contract
9.1. You should understand that the use of Volcano services requires the use of licensed software within the scope of authorization, respect for the intellectual property rights of the software and the content contained in the software, use of the software in accordance with the specifications, and performance of obligations in accordance with this Agreement. If you seriously violate this Agreement, Volcano will terminate the use license.
9.2. Your use of the software depends on the supporting services provided by Volcano's affiliated companies. If you violate the terms, agreements, rules, notices and other related provisions with Volcano and its affiliated companies, you may not be able to use the licensed software normally, and Volcano has the right to terminate the license. Or take restrictive measures on your license and other rights and interests that Volcano can control in the manner agreed in the agreement, including suspending or terminating your license.
9.3. Once you violate this Agreement or other agreements signed with Volcano, Volcano may notify Volcano's affiliated companies and require them to take restrictive measures on your rights and interests, including requiring the affiliated companies to suspend or terminate the provision of part or all services to you, and to publicize your breach of contract on the website operated or actually controlled by them in accordance with the law.
9.4. The licensed software is obtained by you downloading from the download platform. You need to comply with the agreements and restrictions on your use of the licensed software by the download platform, system platform, and terminal manufacturer. If the above third party confirms that you have violated the agreement and need Volcano to deal with it, Volcano may terminate your use license at the request of the third party.
9.5. Upon termination of this License, you shall cease using the Licensed Software and destroy all copies.
9.6. If you violate the terms of this Agreement and cause losses to Volcano or other users, you must bear all liability for compensation.
X. Governing Law and Severability
10.1. The validity, interpretation, amendment, execution and dispute resolution of this Agreement shall be subject to the laws of the People's Republic of China. If there are no relevant legal provisions, reference shall be made to general international business practices and (or) industry practices.
10.2. Any dispute arising from or related to this Agreement may be resolved through friendly negotiation between you and Volcano or submitted to Suite 603, 6/F Laws Commercial Plaza, 788 Cheung Sea Wan Road, Kowloon, Hong Kong, where this Agreement is signed, for arbitration.
10.3. When any clause of this Agreement is ruled invalid by a People's Court with jurisdiction, it will not affect the validity of other clauses or any part thereof, and you and Volcano shall still perform them in good faith.
