Welcome to use TuyaClaw!
TuyaClaw is an AI Agent tool powered by artificial intelligence technology, featuring AI-assisted automated execution capabilities (as defined below) and supporting execution of command tasks (hereinafter referred to as "the Software"). The core functions and specific services provided by the Software are as shown on the product pages (hereinafter referred to as "the Services"). The Software may be updated with different versions from time to time.
Special Notice: The AI capabilities of the Software are provided by third-party large language models. You should fully assess the technical risks associated with large language models, including but not limited to hallucinations, output deviations, and functional configuration limitations, and bear the corresponding risks yourself. Please refer to the relevant clauses of this Agreement for specific rules.
The Software and the Services are provided to you by Tuya!
Please read and fully understand this Agreement before using the Software. By downloading, installing, checking the box, clicking to confirm, registering, logging in, browsing, using, or otherwise expressly or impliedly indicating your acceptance of this Agreement, you are deemed to have read and agreed to be bound by this Agreement. If you do not agree to this Agreement, you may discontinue using the Services.
Before accepting this Agreement, please carefully read and fully understand the following special notices:
  1. The Software is an AI technology tool designed to assist you in improving operational efficiency. Based on the text, files, or other content you input (hereinafter collectively referred to as "Input Content"), it uses generative AI technology (hereinafter referred to as "Large Language Models" or "LLMs") to understand the input content, identify operational intent, and generate command-line instructions, code, text, or other content (hereinafter collectively referred to as "Output Content"), thereby assisting you in invoking local devices or third-party tools to perform local or cloud-based operations.
  2. This software serves only as an interface between you and the large model, tools, and skills, providing technical assistance such as model invocation and tool invocation. All Output Content is generated by the large model based on your Input Content. All operations are carried out by your local tools according to the Output Content. The actions of accessing and operating the local device and third-party software, as well as your installation and use of various tools and skills, are all regarded as your independent actions, and you are solely responsible for the use of this Service and the consequences arising therefrom. Please be sure to operate carefully and protect your information and property security.
  3. When you use a self-configured large language model, the Software only provides the interaction interface and model communication technology. The large language model will process your Input Content independently and return Output Content directly to you. The large language model services and Output Content are provided by your designated large language model service provider, and the relevant rights and obligations shall be governed by the agreement between you and such large language model service provider.
If you are a minor user as defined in the applicable laws, please read and decide whether to agree to this Agreement under the supervision and accompaniment of your guardian, and use the Software and Services under the guidance of your guardian. In particular, please pay attention to the Minor Usage Notice clauses.
I. SCOPE OF THE AGREEMENT
1.1 Applicable Subjects
This Agreement is an agreement between you (or "User") and Tuya regarding your access to, downloading, installation, use, and copying of the Software, as well as your use of the Software-related services.
1.2 Relationship of Agreements
The content of this Agreement also includes relevant agreements and service rules that Tuya may continuously release in the future regarding the Services, as well as platform agreements effective to users on the website where this product is located. Service rules refer to service terms, separate service rules, and explanations involving the service content, technical specifications, operation documents, billing standards, etc. of the Services.
1.3 Agreement Updates
We may adjust this Agreement or service rules according to legal and regulatory requirements, changes in service content, etc., and will publish them on the web page (or through push notifications, pop-ups, or other legal methods). You may review the latest version of the Agreement on the relevant pages. If you continue to use the Services after the Agreement adjustment, it indicates that you have agreed to the modified content. If you do not accept the adjusted Agreement, you may discontinue using the Software.
II. ABOUT THE SOFTWARE AND SERVICES
2.1 Content of the Services
The Services are technical services with AI assistant functions provided by Tuya Smart Inc. (referred to as "we" or "Tuya"), assisting you to invoke local devices or third-party tools through AI intelligent dialogue to perform local or cloud-based operations. The specific services available to you are subject to what is actually provided.
2.2 Form of the Services
We may provide services to you through PC or App, and innovative forms that may emerge with technological development. The specific functions and services are subject to what is actually provided in the version corresponding to the form you use.
2.3 Scope of Software and Service License
2.3.1 Tuya grants you a non-transferable, non-sublicensable, non-exclusive license to use the Software and Services in accordance with this Agreement. You may obtain and use the Software and Services for non-commercial purposes on one or more devices, regardless of whether such devices belong to you. You shall be responsible for and bound by this Agreement for using the Software and Services on any device.
2.3.2 Other rights not expressly authorized in this Agreement are reserved by Tuya. You must obtain Tuya's written permission when exercising these rights.
2.4 Equipment Required for Services: The Software and Services require you to have compatible device terminals and operating systems. Such device terminals must also be able to access the network stably; otherwise, we may not be able to meet your needs for using the Software and Services. Please note that the content and functions of using the Software and Services may vary depending on different terminal models, operating systems, etc.
2.5 Purpose of Services: The purpose of the Services is to help users launch functions and solve problems more quickly, aiming to provide users with efficiency tools. The Output Content of AI-related services is generated by generative AI technology and does not represent our position. The relevant content is for your reference only. You shall bear the responsibility for any judgments made based on the Output Content or any subsequent related operational actions. Please use the Services prudently, rationally, and in accordance with law.
2.6 Based on the technical characteristics of large language models and artificial intelligence, the Output Content of AI-related services in the Services has randomness and uniqueness cannot be guaranteed. Therefore, you understand and agree that the large language model may output the same or similar Output Content to different users, or generate different Output Content for the same Input Content.
III. OBTAINING THE SOFTWARE
3.1 You may obtain the Software and Services directly from Tuya's website or from third parties authorized by Tuya.
3.2 If you obtain the Software or installation programs with the same name as the Software from third parties not authorized by Tuya, Tuya cannot guarantee that such services will function properly.
IV. SOFTWARE INSTALLATION AND UNINSTALLATION
4.1 Tuya may develop different software versions for different terminals, systems, etc. Please install the appropriate version according to your actual terminal, system, etc., so that you can use the Software and Services normally.
4.2 To provide better quality and safer services, Tuya may recommend other software for installation during the Software installation. You may freely choose whether to install them according to your personal wishes.
4.3 If you no longer need to use the Software or need to install a new version, you may freely uninstall and update.
V. SOFTWARE UPDATES AND ADJUSTMENTS
5.1 Software Updates: To improve user experience and perfect service content, Tuya will continuously strive to develop new services and provide you with updates to the Software and Services from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.), or change or limit some functions and effects of the software.
5.2 Please note that after the new version of the Software is released, the old version may not be usable, and relevant customer service and maintenance services may not be available. Please check and download the latest version in a timely manner. Tuya will notify you through pop-ups, red dot prompts on the service page, etc., when a new version is available. The specific notification method is subject to what is actually provided.
5.3 Software Adjustments: Due to the rapid development of the Internet industry and AI technology, you understand and agree that we have the right to make necessary changes to the Services according to business development, laws, regulations, and regulatory policy changes, such as adjusting service content or suspending or terminating services. We will notify users through prominent methods (such as app push, site push, service announcements, etc.).
VI. USER PERSONAL INFORMATION PROTECTION
6.1 Protecting user personal information is a basic principle of Tuya. Tuya will take reasonable measures to protect users' personal information. Except as provided by laws and regulations, Tuya will not disclose user personal information to third parties without user permission. Tuya adopts professional encryption storage and transmission methods to ensure the security of users' personal information.
6.2 For how we collect, use, store, and protect your personal information and what rights you enjoy, you may read the "TuyaClaw Privacy Policy" for further understanding.
VII. MAIN RIGHTS AND OBLIGATIONS
7.1 Account Usage Rules
7.1.1 The Services may provide you with various registration and login methods. Regarding the specific rules for using your account, please comply with this Agreement and relevant usage rules for the Software account published by Tuya.
7.1.2 To ensure the security of your account, please keep your account and password safe. Your account is limited to your personal use only, and you may not register more than a reasonable number of accounts. You may not gift, lend, rent, transfer, sell, or otherwise permit others to use your account. Non-initial applicants may not use accounts through gift, inheritance, lease, assignment, or other means.
7.1.3 During account registration or use of the Services, you need to provide some necessary information. If special provisions are made by national laws and regulations, you need to fill in true information (such as mobile phone number, etc.). If the information you fill in is incomplete, untrue, non-standard, or illegal, you may not be able to use the Services normally.
7.1.4 When you register an account or use the Services, if we discover that your account may involve fraud, false registration, or other abnormal situations or risks, Tuya has the right to re-verify your account according to relevant laws and regulations, and may take corrective measures within a time limit, function restrictions, suspension of use, account closure, account freezing, prohibition of re-registration, and other disposal measures stipulated in this Agreement according to the risk situation.
7.1.5 If you need to cancel your account due to personal reasons, you may follow the account cancellation guidelines within the Services. Before cancellation, please ensure that you have read the important reminders for account cancellation and confirmed that all services related to the account have been properly handled.
7.2 User Notices
7.2.1 You understand and agree that: To provide effective services to you, the Services will utilize the processor and bandwidth of your computer terminal and assist you in invoking resources such as the large language model you have custom-configured. Data traffic, token consumption, and other fees may be incurred during the use of the Services. Users need to inquire about relevant fee information from the corresponding entities and bear the relevant costs themselves. If other fees are generated in the Services, the details shall be subject to the product interface description.
7.2.2 You may operate local devices or third-party software through the Software. We hereby explain to you:
(1) All operations on your local device files and systems are performed based on the Output Content generated from your Input Content. The Software only provides technical assistance such as local tool invocation. We recommend that you carefully judge and operate with caution, especially operations that may have significant or irreversible impacts such as file writing, deletion, moving, or modification of system key configurations. Due to the real-time nature of AI-assisted automated execution capabilities, please carefully issue high-risk instructions, especially those involving system settings, file modifications, data deletion, instant messaging (such as mass messaging), shopping order communications (such as purchasing goods), etc. You should also make real-time judgments and final confirmations on each execution action of the product.
(2) When you use the Software to access third-party software or services, the third-party software service provider will provide services to you. We recommend that you carefully read and comply with the service agreement and usage rules of such third-party software. You clearly understand that we do not assume any responsibility for the accuracy, defects, or legality of third-party platforms, products, or pages you access through the Software. You should judge the authenticity and reliability of the content of third-party platforms, products, or pages yourself.
(3)You understand the above explanations and agree that you may not use the Services to bypass or crack technical protection measures of third-party software, or engage in illegal or non-compliant acts that may infringe upon the legitimate rights and interests of third parties. All consequences arising from your operations on local devices or third-party software through the Software (including disputes, penalties, or losses with third parties) shall be borne by you.
7.2.3 The Software may support you in configuring self-obtained large language model services (referred to as "Custom Models"). You understand that when you use this function, the Software only provides the interaction interface and model communication technology. Your Input Content is sent directly by you to the large language model, which will process it independently and return Output Content directly to you. You agree that:
(1) You must ensure that the Custom Model you configure is purchased or authorized through legal channels. You may not access third-party model services from unknown, illegal, or infringing sources.
(2) You shall bear all costs arising from invoking your configured Custom Model (such as Token consumption fees, subscription plan fees, etc.). As Input Content may continuously invoke the model, we recommend that you closely monitor the account fee status of the Custom Model to avoid incurring unexpected costs.
(3) You must ensure that your configuration and use of Custom Models in the Services comply with the rules and requirements of the large language model service provider. If any disputes, losses, or damages arise from the large language model service, you shall resolve them with the large language model service provider.
7.3 Advertisements
7.3.1 You agree that Tuya may send and display advertisements or other information (including commercial and non-commercial information) to you by itself or through third parties via SMS, email, or electronic information in various ways. The specific sending and display forms, frequency, and content of advertisements or other information are subject to what is actually provided.
7.3.2 Tuya will conduct advertising business in accordance with relevant laws and regulations. For advertisements appearing in the Services, you should carefully judge their authenticity and reliability.
7.4 The Services may provide default large language models (specific algorithm model information is detailed in the "Algorithm and Model Filing Information Statement") for your experience. To comply with national laws and regulations regarding deep synthesis services and generative AI services, and to promote the transparent use of AI-generated synthetic content, we will add explicit or implicit identifiers in the product interaction interface or AI-generated synthetic content. Please be sure to carefully read and understand the relevant identification management requirements. You may not use the Services to create, publish, or disseminate false, untrue, infringing, or other information that violates laws and regulations. Specific identification methods include: displaying "AI Generated" or other prompt text containing AI elements and generative synthesis elements at appropriate positions such as the top, bottom, background of the product interaction interface, or near the displayed content.
We will preserve log information in accordance with laws, administrative regulations, and relevant national regulations. When you disseminate content generated by the Services through the Internet, you should maintain the accuracy and integrity of the above content identifiers.
VIII. USER CONDUCT RULES
8.1 Information Content Rules
You understand and agree that Tuya is committed to providing users with a civilized, healthy, standardized, and orderly network environment. You may not use the Services to create, upload, copy, publish, transmit, disseminate, or repost content that may interfere with the normal operation of the Services, infringe upon the legitimate rights and interests of other entities, or violate national laws and regulations, including:
(1) Opposing the basic principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Damaging national honor and interests;
(4) Distorting, vilifying, desecrating, or denying the deeds and spirit of heroes and martyrs, or infringing upon the names, portraits, reputations, or honors of heroes and martyrs through insult, defamation, or other means;
(5) Promoting terrorism or extremism, or inciting the implementation of terrorist or extremist activities;
(6) Inciting ethnic hatred or discrimination, or undermining ethnic unity;
(7) Undermining national religious policies, or promoting cults or feudal superstitions;
(8) Spreading rumors, disturbing social order, or undermining social stability;
(9) Spreading obscene, pornographic, gambling, violent, or terrorist content, or inciting crime;
(10) Insulting or defaming others, or infringing upon others' reputations, privacy, or other legitimate rights and interests;
(11) Using exaggerated titles where the content seriously does not match the title;
(12) Hyping gossip, scandals, or misdeeds;
(13) Inappropriately commenting on natural disasters, major accidents, or other disasters;
(14) Containing sexual hints or sexual provocations that easily cause sexual associations;
(15) Displaying bloody, horrifying, or cruel content that causes physical or mental discomfort;
(16) Inciting crowd discrimination or regional discrimination;
(17) Promoting vulgar, philistine, or kitsch content;
(18) Content that may cause minors to imitate unsafe behaviors or violate social ethics, or induce minors to develop bad habits;
(19) Content that infringes upon the legitimate rights and interests of minors or damages the physical or mental health of minors;
(20) Inciting illegal assemblies, associations, parades, demonstrations, or gatherings to disturb social order;
(21) Activities conducted in the name of illegal civil organizations;
(22) Violating the "Seven Bottom Lines" requirements of laws and regulations, the socialist system, national interests, citizens' legitimate rights and interests, social public order, moral standards, and information authenticity;
(23) Other content prohibited by laws or administrative regulations, or content that adversely affects the network ecology.
8.2 To protect our legitimate interests and those of other users, you should not use or attempt to use technical measures or other means to engage in the following behaviors:
(1) Reverse engineering, decompiling, translating, or otherwise attempting to discover the source code or underlying components of the models, algorithms, and systems of the Software and Services and their dependent programs, software, information, data, algorithms, and models;
(2) Using automated or other means to bypass, crack protection measures, or adopt improper means that may affect the normal operation of the Software and Services to capture, steal, collect, or extract data;
(3) Creating mirror pages of the Software and Services web pages, or using technical means to reproduce or copy the Software and Services;
(4) Deleting, modifying, covering, or otherwise replacing commercial names, trademarks, service marks, domain names, or other obvious marks of us and our partners that may be included during the provision of the Software and Services, or deleting copyright statements, trademark statements, or other ownership statements contained in the Software and Services;
(5) Deleting, tampering with, or concealing identifiers (including visible prominent identifiers on generated content and hidden identifiers embedded in generated content metadata files through specific technical means) that we have marked for AI-generated content;
(6) Bypassing or breaking through technical protection measures set by third-party software and services, implementing illegal intrusion into networks, interfering with network and service normal functions and operations, or other acts that endanger network security and data security;
(7) Using the characteristics of the Software and Services to make malicious or abnormally frequent requests, calls, or accesses to third-party services or websites, or implementing traffic attacks, automated registration, batch operations, or other acts that interfere with the normal operation of third parties;
(8) Other acts that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of the product, or are not expressly authorized by Tuya.
8.3 You fully understand and agree that you are responsible for your actions in using the Software and Services. For your Input Content, you should ensure that:
(1) The Input Content does not violate the provisions of this Agreement;
(2) The Input Content is owned by you or you have obtained full, necessary, and valid legal licenses and authorizations from the rights holders involved in the Input Content, without infringing upon the legitimate rights and interests of third parties (such as intellectual property rights, portrait rights, reputation rights, privacy rights, trade secrets, etc.), and you may not cause the Services to generate content that infringes upon the legitimate rights and interests of third parties through the Input Content or other means;
(3) If your Input Content involves personal information, please ensure that you have obtained the informed consent of the relevant personal information subjects (for sensitive personal information, separate consent should be obtained).
8.4 Breach Handling
8.4.1 You understand and agree that if Tuya discovers or receives reports or complaints from others that a user has violated this Agreement, Tuya has the right to take deletion, blocking, and other measures at any time without notice, and depending on the circumstances of the violation, take measures such as warnings, restricting or prohibiting the use of some or all functions, account banning, account freezing, account cancellation, and other disposal measures against the relevant accounts of the violating party. Users shall bear the corresponding consequences (including the clearing of user data and related data, products or services becoming unusable, etc.) and legal responsibilities arising therefrom.
8.4.2 You understand and agree that if you violate this Agreement or relevant service terms, resulting in claims, demands, or losses asserted by third parties, you shall bear the responsibility independently; if Tuya suffers losses as a result, you shall also compensate accordingly.
IX. INTELLECTUAL PROPERTY RIGHTS
9.1 Tuya is the owner of the intellectual property content such as programs and software relied upon by the Services and the Software. The copyright, trademark rights, patent rights, trade secrets, and other intellectual property rights of the Services and Software are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. Tuya enjoys the above-mentioned intellectual property rights according to law, except for rights that should be enjoyed by relevant rights holders according to law. The LOGOs and other commercial identifiers used by Tuya in the Services, their copyright or trademark rights belong to Tuya.
9.2 Without the written consent of Tuya or relevant rights holders, you may not implement, utilize, or transfer the above intellectual property rights by yourself or permit third parties to do so.
9.3 The Software may display or mention the names, brands, or trademarks of third-party software or services during operation (such as the name of the Custom Model you configure). You understand that such display is for identification purposes only, to indicate that the Software and Services are interacting with the corresponding third party based on your Input Content. This does not indicate that we have an affiliation or partnership with such third parties. The rights to such third-party brands and trademarks remain with their respective rights holders.
9.4 The Input Content you submit through the Software and the Output Content you obtain using the Software's default large language model belong to you or the rights holders who legally enjoy such intellectual property rights. Your use of the Services will not affect the ownership of the aforementioned content. If you use a Custom Model for Output Content, the ownership of such content and related rights and obligations shall be determined according to the agreement between you and the large language model service provider. Please pay attention to reviewing and complying with their agreements or documents when using the Output Content.
X. LIMITATION OF LIABILITY
10.1 You understand and agree that the AI-related services in the Services are provided for your reference only and do not constitute any advice or guidance for your operations. You shall bear full review and decision-making responsibilities for any operations you perform based on the Output Content. Especially when making decisions regarding major matters such as credit, investment and financing, wealth management, insurance, law, healthcare, and education, you should independently and carefully assess the content you come into contact with when using this service, including the risks arising from reliance on the correctness, completeness or practicality of the content. In particular, for operations that may have significant impacts or irreversible consequences (such as batch deletion of files, modification of critical system configurations, execution of financial transactions, etc.), you bear the ultimate and complete responsibility for review and decision-making.
10.2 You understand and agree that during the use of the Software and Services, you may encounter force majeure and other risk factors that affect the Software and Services. Force majeure refers to objective events that cannot be foreseen, overcome, or avoided and have a significant impact on one or both parties, including natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, disturbances, and government actions. In the event of the aforementioned circumstances, Tuya will strive to cooperate with relevant units in a timely manner to handle the situation, but Tuya is exempt from liability for losses caused to you within the scope permitted by law.
10.3 Please note that within the scope permitted by law, Tuya is not responsible for service interruptions or obstructions caused by the following circumstances:
(1) Damage caused by computer viruses, Trojan horses, or other malicious programs or hacker attacks;
(2) Failures in the user's computer software, system, hardware, and communication lines;
(3) Improper user operation or use of the Software and Services in a manner not authorized by Tuya;
(4) Outdated software versions used by the user, aging of user equipment, or compatibility issues;
(5) Other circumstances that Tuya cannot control or reasonably foresee.
10.4 You understand and agree that Tuya will use technical means to reasonably ensure the security of your data storage in the Software to the extent possible, but Tuya cannot provide complete guarantees in the following circumstances:
(1) Within the scope permitted by law, Tuya is not responsible for the deletion or storage failure of your relevant data in the Software and Services caused by reasons other than Tuya;
(2) If you stop using the Software and Services, or if your services are terminated or cancelled due to violation of laws, regulations, or this Agreement, Tuya will delete your data from the server after an appropriate period. After your services are stopped, terminated, or cancelled, Tuya will no longer be obligated to return relevant data to you. You should make backups yourself before the services are stopped, terminated, or cancelled;
(3) In compliance with relevant laws and regulations, Tuya has the right to decide the maximum storage period for individual users' data in the Software and Services according to actual circumstances, and allocate maximum data storage space on the server, etc. You may make backups of relevant data in the Software and Services according to your own needs.
10.5 We are committed to providing safe, stable, and continuous services to ensure users' normal use. You understand and agree that although we have made our best efforts, due to the limitations of AI and large language model technology development, we cannot fully guarantee that:
(1) The Services or algorithm models will meet your actual or specific needs or purposes;
(2) The Services or algorithm models are 100% accurate, reliable, functional, continuously stable, and free of faults;
(3) The large language models and related technologies relied upon by the Services can fully understand user input content like humans. You understand that they may not be able to discover potential risks and ethical issues in your Input Content or the Output Content of the Services;
(4) The authenticity, completeness, accuracy, timeliness, and practicality of the Output Content;
(5) The Output Content is free from defects, false content, or unreasonable or user-disturbing content.
In view of this, please carefully verify the Output Content of the large language model and make rational judgments based on your actual situation.
10.6 The operations assisted by the Services are implemented based on the Output Content formed by the large language model's understanding and analysis of your Input Content. Given the inherent limitations of AI technology, the large language model may misunderstand your Input Content or generate unpredictable Output Content without clear intent. Although we may have set up user confirmation steps before some operations, we are not responsible for losses caused by large language model understanding errors, execution deviations, or any unexpected automated behaviors. Before executing operations, you should make your own careful judgments regarding their accuracy and potential consequences.
XI. THIRD-PARTY SOFTWARE OR TECHNOLOGY
11.1 The Software may use third-party software or technology. If such software requires a separate license agreement, the relevant rights and obligations shall be governed by such separate license agreement. If such software does not require a separate license agreement, your use of such software shall be governed by this Agreement and the relevant open-source license. If you have any disputes regarding such software, you may request Tuya to provide assistance, but you shall bear the legal responsibilities yourself.
11.2 If disputes arise from third-party software or technology, such disputes shall be resolved by the third party. Tuya does not provide customer support for third-party software or technology. If you need support, please contact the third party.
XII. MISCELLANEOUS
12.1 The place of signing of this Agreement is Xihu District, Hangzhou City, People's Republic of China.
12.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China (excluding conflict of laws).
12.3 If a dispute or controversy arises between you and Tuya, it shall first be resolved through friendly consultation; if consultation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction in the place of signing of this Agreement.
12.4 The headings of all clauses in this Agreement are for convenience of reading only and have no actual meaning, and shall not be used as a basis for interpreting the meaning of this Agreement.
12.5 If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding.

If you have questions or suggestions regarding this Agreement or the Services, or need to report or complain about discovered violations, you may submit them through the feedback entry on the product page.
